  1. ABOUT US
    Musieksentrum Monumentpark CC, is a music learning centre (“Business Purpose”). We operate from
    Laerskool Monumentpark and offer music as an extra mural activity. From time to time we process
    personal information in connection with our Business Purpose based on a contractual arrangement with
    our clients. We value the importance of protecting personal information and respect the privacy of our
    data subjects.
    We are a responsible party in terms of the Protection of Personal Information Act, 4 of 2013 (POPI Act)
    who determines the purpose for which we process personal information. We do not process personal
    information on behalf of others and do not consider ourselves to be an Operator in terms of the POPI
    Act.
    We process personal information related to the following data subjects: learners / children, caregivers
    of learners, our employees and our suppliers. We use external service providers for accounting and
    information technology services. We take reasonable measures to ensure the protection of personal
    information.
    This Notice applies to all data, including personal information past, present or future, that you submit to
    us or that we otherwise obtain during the course of business.
    The Managing Director is the POPI Information officer. If you have any concerns or questions please
    contact the Information Officer at navrae@monniemusiek.co.za .This Notice may be updated from time
    to time.

    We hereby inform you that when we engage for the Business Purpose you may need to provide us with

    b) Contact Information (including e-mail, physical & home addresses, contact number)
    c) Attendance Information (including meeting or training records)
    d) Access Information (including access register, Covid forms)
    e) Information required by law
    We do not process special personal information of data subjects.
  3. REASONS FOR COLLECTING PERSONAL INFORMATION
    We only collect and process personal information specific to the Business Purpose or for a legitimate
    business purpose, that we need in order to comply with our contractual obligations and that allows
    compliance with obligations imposed upon us in terms of law. The personal information you provide to
    us is typically processed for purposes connected to our legitimate business purposes:
    CHILDRENS’ INFORMATION
    We use your child’s personal information –
    a) To identify the child
    b) To provide an appropriate standard of service
    c) To support learning
    d) To monitor and report progress
    e) To assess the quality of our services

    CAREGIVERS’ INFORMATION
    a) To comply with our contractual duties

    e) To communicate and collaborate with you
    f) To assess the quality of our services
    g) To protect our rights
    If it becomes necessary to collect additional information from you, it will be done on a voluntary
    participation basis.
  4. METHODS FOR COLLECTING PERSONAL INFORMATION
    We collect personal information directly from data subjects at the start of our business relationship or as
    soon thereafter as practically possible, by means of –
    a) Client Application Form / Contract
    b) Financial records (invoice etc)
    c) Access Register
    d) Attendance Register
    We don’t collect personal information by automatic means.
  5. SHARING OF PERSONAL INFORMATION
    We will not share the personal information or special personal information of data subjects with third
    parties without the data subject’s consent, unless the law or our policies allow us to do so.

    Personal information is shared on a need to know basis for purposes connected to our Business
    Purpose or as may be required by law. Those given access are required to maintain confidentiality. We
    limit the sharing of personal information to –
    a) Contracted services providers
    b) Professional advisors
    c) Competent authorities on request
    From time to time we will share personal information –
    a) Via social media platforms
    b) Via e-mail / Whatsapp
    We do not share personal information with third parties for their own direct marketing purposes and we
    do not sell personal information to third parties.
  6. STORING OF PERSONAL INFORMATION
    We will take reasonable measures to keep personal information safe and secure, accurate and
    updated. These measures include –
    a) Staff training and education to create awareness around privacy and security.
    b) Administrative control measures including POPI Act notices and consent forms regarding use of
    personal information.
    c) Physical security measures such as access control measures. We operate from the School’s
    premises.
    d) Technological security measures. We apply access control measures to protect personal
    information.
    Despite our best efforts we can’t absolutely guarantee the security of personal information.
    We do not store credit card information.
    We will retain your personal information for the longest of the following periods:
    a) For as long as necessary to render services to you or respond to requests
    b) For as long as required by law
    c) The end of the period in which litigation or investigations might arise in respect of the services

    d) Until we are requested to delete or destroy the personal information
  7. YOUR RIGHTS IN RELATION TO YOUR PERSONAL INFORMATION
    We confirm your rights with regard to our processing of your personal information:
    a) To request access to your personal information held by us.
    b) To request information regarding the sharing of your personal information with third parties.
    c) To have your personal information corrected or updated where necessary .
    d) To object to our processing of your personal information.
    e) To prevent the processing of personal information for direct marketing purposes
    If you are concerned that we have processed your personal information in a manner or for a purpose
    which is contrary to the provisions of this Policy, please resolve the matter with the assistance our
    Information Officer. You have the right to lodge a complaint with the Information Regulator, under the
    provisions of POPI:
